1. DESCRIPTION: The “Champions Online Registration Sweepstakes” ("Sweepstakes") begins at 12:01 AM [PST] on Tuesday, July 28th, 2009 (“Start Date”) and ends at 11:59 PM [PST] on Sunday, August 16, 2009 ("Sweepstakes Period"). The Sponsor of this Sweepstakes is Cryptic Studios, Inc ("Sponsor").
2. ELIGIBILITY: Sweepstakes is open to legal residents of the forty-eight (48) continental United States and Washington, D.C. (specifically excluding Alaska, Hawaii, Puerto Rico and other US territories and possessions) who have reached the age of eighteen (18) in their state/province of residence at time of entry and who have internet access as of the Start Date. Any individuals (including but not limited to employees, consultants, independent contractors and interns) who have, within six months prior to the Start Date, held employment with or performed services for Sponsor or any organizations affiliated with the sponsorship, fulfillment, administration, prize support, judging, advertisement or promotion of the Sweepstakes (collectively, "Sweepstakes Entities") are not eligible to enter or win. Immediate family and household members of such individuals are also not eligible to enter or win. "Immediate Family" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. "Household Members" shall mean those people who share the same residence at least three months a year. VOID WHERE PROHIBITED.
3. HOW TO ENTER: There are two ways to enter the Sweepstakes: (1) Register an account on the Champions Online web site by logging on to http://www.champions-online.com. Follow the on-screen instructions to submit an entry by registering for the Champions Online community. Entries must be complete and accurately fill-out all fields in the registration form. Registration is free. Those with pre-existing registration automatically receive one (1) entry. When you register for the Community, you may be asked to consent to receive promotional e-mails and reminders for upcoming Champions Online events or other promotional activities. Consenting to receive such e-mails is optional and does not have to be agreed to in order to be eligible to enter the Sweepstakes and does not improve your chances of winning. OR (2) Eligible entrants may hand-print on a postcard your name, address (including zip/postal code), email address (if available), and date of birth, and mail it with the correct postage to Champions Online Sweepstakes, Cryptic Studios, Inc. P.O. Box 321213, Los Gatos, CA 95032. No mechanically reproduced entries permitted. Each entry must be mailed separately.
All online entries must be received by 11:59 PM [PST] on August 16, 2009. All mail-in entries must be received by Sponsor no later than August 16, 2009. Entrants must provide all information requested by Sponsors to be eligible to win. Incomplete, unreadable, or unintelligible entries will be disqualified. All information provided by entrants becomes the property of Sponsor and will not be returned or acknowledged. Proof of submission does not constitute proof of entry. LIMIT ONE ENTRY OR REGISTRATION PER PERSON, REGARDLESS OF EMAIL ADDRESS USED OR METHOD OF ENTRY. Entries generated by script, macro or other automated means are prohibited and, upon discovery by Sponsor, will be disqualified.
4. PRIZES: Grand Prize (1): One (1) Grand Prize Winner will be selected to receive: one (1) round-trip flight to PAX, one (1) paid hotel stay for four (4) nights in Seattle, WA, and one (1) paid dinner with the Cryptic staff that are present at PAX. Estimated retail value of the Grand Prize is $2500. A Grand Prize Winner will not be compensated in any other way should any element of the prize be deemed not feasible. All other prizes will be awarded. If a prize cannot be awarded due to circumstances beyond the control of Sponsor, a substitute prize of equal or greater retail value may be awarded, provided, however, that if prizes are awarded but unclaimed/forfeited by recipient, prize may not be re-awarded, in Sponsor's sole discretion. Prize winners cannot assign or transfer the prize to another person. No cash or prize substitution is allowed except at the discretion of Sponsor. Winners will be responsible for all taxes, including income taxes, or fees due on the prizes awarded. Other restrictions may apply.
5. WINNER SELECTION AND NOTIFICATION: Potential Winner will be selected at random on or about August 17, 2009. ODDS OF WINNING DEPEND ON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED. All potential Winners will be notified by telephone, email and/or overnight mail on or about August 17, 2009. Selected Potential Winner will be required to respond (as directed) to the notification within 72 hours of attempted notification. The failure to respond timely to the notification and/or to complete and return required documentation or to otherwise fail to comply with these Sweepstakes rules may result in forfeiture of the prize and, in such case, Sponsor will select an alternate winner by random drawing from among remaining eligible entries. Grand prize winner will be required to verify address and to execute before a notary public and return within seven (7) days an affidavit of eligibility and liability/publicity release covering tax reporting requirements, eligibility, liability, advertising, publicity and media appearance issues, unless prohibited by law. Prizes will not be awarded until all such properly executed and notarized forms are returned.
6. CONDITIONS OF PARTICIPATION/RELEASES: Sweepstakes is void where prohibited or restricted by law. All federal, state/provincial and local laws and regulations apply. By participating, entrants agree to be bound by these official rules and the decisions Sponsor, which shall be final in all respects. By participating in this Sweepstakes and/or by accepting any prize that they may be awarded, entrants agree to release the Sweepstakes Entities, their respective parent, subsidiary and affiliated companies, units and divisions, licensors, and advertising and promotional agencies and prize suppliers; each of their respective officers, directors, agents, representatives and employees; and each of these companies and individuals' respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Sweepstakes and/or acceptance or use of the prize. Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state/province of residence and entry materials in programming or promotional material, worldwide in perpetuity, or on a winner's list, if applicable, without further compensation unless prohibited by law. The Released Parties shall not be liable for: (i) late, lost, postage-due, delayed, stolen, misdirected, incomplete unreadable, inaccurate, garbled or unintelligible entries, communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Sweepstakes; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Sweepstakes. The Released Parties shall not have any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Sweepstakes, and reserves the right, in their sole discretion, to cancel, modify or suspend the Sweepstakes should a virus, bug, computer problem, unauthorized intervention or other causes beyond Sponsor's control, corrupt the administration, security or proper play of the Sweepstakes. Released Parties may prohibit you from participating in the Sweepstakes or winning a prize if, in their sole discretion, they determine you are attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, submissions of multiple entries, deception, or any other unfair playing practices or of intending to annoy, abuse, threaten or harass any other players or Released Parties’ representatives. This Sweepstakes will be governed by the internal laws of the State of California. Any and all legal actions or claims arising in connection with this Sweepstakes must be brought in a court of competent jurisdiction within the United States. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE SWEEPSTAKES. SHOULD SUCH AN ATTEMPT BE MADE, RELEASED PARTIES RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
7. FORCE MAJEURE: The failure of the Released Parties to comply with any provision of these Official Rules due to an act of god, hurricane, war, fire, riot, earthquake, act of public enemies, actions of governmental authorities outside of the control of the Released Parties (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.
8. PRIVACY POLICY: Any personal information supplied by you to Sponsor will be subject to Sponsor’s privacy policy posted at http://www.champions-online.com/legal_terms. By entering the Sweepstakes, you grant Sponsor permission to share your email address and any other personally identifiable information with the corresponding Sweepstakes Entities as may be necessary in connection with the administering of this Sweepstakes. Subject to your ability to opt-out, you will be automatically registered as a member of Sponsor’s web site and subject to its privacy policy posted at http://www.champions-online.com/legal_terms. As a result, you may receive additional email communication or promotions from the Sponsor as any of their members would. Sponsor will not sell, rent, transfer or otherwise disclose your personal data to any third party other than the Sweepstakes Entities.
